Possible penalties for content generated by artificial intelligence

In recent years, due to the rapid development of artificial intelligence technologies, creating photo, video, and audio materials has become much easier. However, along with the widespread use of these technologies, the risk of disinformation, fake visuals, and manipulative content has also increased. For this reason, new legal requirements regarding the distribution of AI-generated content are currently being discussed in Azerbaijan.

According to the draft law submitted to the Parliament, materials created using artificial intelligence may be required to be clearly labeled.

 

What changes are proposed to the law?

During a joint meeting of the Parliamentary Committees on Legal Policy and State Building and Human Rights, it was proposed to add a new Article 13-2.7 to the Law “On Information, Informatization and Protection of Information.”

According to the proposed amendments:

  • Photos, videos, and audio materials created using artificial intelligence, when distributed publicly,
  • must clearly indicate that the material was generated using AI technology.

This means that users and viewers should be able to easily understand that the content is not real footage but an AI-generated product.

 

What does “labeling” mean?

The draft law also explains the concept of “labeling.”

Labeling refers to adding special indicators showing that the material was created using artificial intelligence.

These indicators may include:

  • Text-based notice – for example: “Generated by AI”
  • Visual signs or watermark
  • Audio notification or disclaimer
  • Automatic labeling added by the platform or AI system

Thus, users will have transparent information about the origin of the content being shared.

 

What happens if the content is not labeled?

The draft law also предусматривает liability measures.

According to the proposed Article 388-3 of the Code of Administrative Offenses, if AI-generated photo, video, or audio materials are distributed in the media or on the internet without labeling, the responsible persons may be fined:

from 80 to 150 AZN.

This rule may apply particularly to:

  • social media posts
  • media platforms
  • news websites
  • publicly distributed internet content

 

What is the purpose of these changes?

The proposed legislative amendments aim to address several important issues:

1. Preventing disinformation
AI-generated fake videos and images can mislead the public.

2. Reducing the risks of deepfake technologies
Especially to prevent fake content created in the name of public figures.

3. Ensuring transparency in the information environment
Users should be able to distinguish between real and artificial content.

4. Increasing responsibility in media and social networks
Content creators must clearly indicate the origin of the materials they share.

 

Although artificial intelligence technologies are becoming part of many areas of our lives, their use should be regulated by legal and ethical standards. The legislative changes being discussed in Azerbaijan are considered an important step in this direction.

Labeling AI-generated photo, video, and audio materials will help increase transparency and prevent the spread of fake and manipulative content.
